These Rental Terms & Conditions (“RTC”) govern the furnished short-term (holiday) and long-term (off-season) rental of the accommodations offered by Azur Stay in Saïdia. The booking covers the entire accommodation, for temporary residential use only, excluding any professional or commercial use. Any booking implies full and unreserved acceptance of these RTC.
Bookings can be made online through the website's booking engine, or by WhatsApp and e-mail. A booking becomes firm upon receipt of the deposit payment (article 5) and of the written confirmation sent by Azur Stay, specifying the accommodation, the dates, the number of guests, the total price and the address. No dates are guaranteed until the deposit has been received.
Prices are shown in euros (€), per night and for the entire accommodation, with no hidden fees. The rate depends on the season and the chosen dates. Booking directly on this website guarantees the best rate, with no middleman commission. Any minimum-stay requirements are indicated on each accommodation's page and in the booking engine.
A payment of 25% of the total amount, as a booking deposit (arrhes), is required at the time of booking to secure the dates. The balance (75%) is paid on arrival (bank card or cash), or up to 2–3 days before arrival by bank transfer if the guest prefers. No full prepayment is ever required, which notably allows last-minute bookings. Accepted methods: online card payment (secured via Smoobu and Stripe) for the deposit, then card, cash or transfer for the balance.
The sums paid at booking constitute a deposit (arrhes) within the meaning of the Moroccan Code of Obligations and Contracts (Dahir). In the event of cancellation by the guest at least 14 days before the arrival date, the deposit is refunded. In the event of cancellation less than 14 days before arrival, or of a no-show, the deposit is retained by Azur Stay and the dates are put back up for rental. Bookings made less than 14 days before arrival are therefore non-refundable. Azur Stay undertakes, for its part, to honour every confirmed booking.
Any request to change a booking (dates, length of stay, number of guests) is subject to Azur Stay's agreement and to availability. An accepted change gives no right to a refund if it reduces the initial amount, unless otherwise agreed in writing.
Check-in from 3 pm; check-out no later than 11 am. A valid identity document is required on arrival, in accordance with regulations. Any late departure that has not been agreed may be charged.
Each accommodation is rented for a maximum number of guests stated on its page. This number may not be exceeded without Azur Stay's prior written agreement, on pain of immediate termination without refund. The accommodation must be occupied peacefully, respecting the neighbours and the tranquillity of the residence; parties and noisy events are prohibited.
No security deposit is required, neither at booking nor on arrival. The guest nevertheless remains liable for any damage they may cause, in accordance with article 11.
The guest agrees to use the accommodation in accordance with its purpose, to comply with the residence's internal rules, to report any damage without delay, and not to sublet or transfer the booking. The guest is liable for damage caused by themselves or their companions during the stay.
Azur Stay undertakes to provide a clean accommodation that matches its description, and to provide assistance during the stay. Azur Stay cannot be held liable for the theft or loss of personal belongings, for interruptions beyond its control (water, electricity or internet outages, neighbouring building work), or for cases of force majeure. The photographs on the website are indicative.
Neither party may be held liable for failure to perform its obligations in the event of force majeure. If a major impediment makes the accommodation unavailable, Azur Stay will offer, subject to availability, a postponement or an equivalent accommodation; failing that, the sums paid for the period concerned will be refunded.
Guests are advised to hold insurance covering the risks related to their stay (civil liability, cancellation). Azur Stay does not provide cancellation insurance.
The data collected for the booking is processed in accordance with our Privacy Policy (Moroccan law 09-08 and GDPR). Online payment is processed securely by Smoobu and Stripe; Azur Stay does not store any bank details.
These RTC are governed by Moroccan law. In the event of a dispute, the parties will first endeavour to find an amicable solution. Failing that, the dispute will be brought before the competent Moroccan courts.
By confirming a booking (online, by WhatsApp or by e-mail) and/or by paying the deposit, the guest acknowledges having read these Rental Terms & Conditions and accepts them without reservation.
